제1조. 목적

1. Acceptance of Terms

본 약관은 Twinflo(이하 '회사')가 제공하는 AI 워크플로우 모바일 앱 서비스(이하 '서비스')의 이용 조건 및 절차, 이용자와 회사의 권리, 의무 및 책임사항 등을 규정함을 목적으로 합니다.

By downloading, installing, or using the Twinflo mobile application ('Service'), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

제2조. 이용 자격

• 만 14세 미만(한국) 또는 13세 미만(미국)은 서비스를 이용할 수 없습니다.
• You must be at least 14 (Korea) or 13 (US) years of age to use the Service.
• 앱 최초 실행 시 연령 확인 절차를 거칩니다.
• Upon first launch, you must confirm you meet the minimum age requirement.
• 사업자 또는 조직을 대표하여 이용하는 경우, 해당 주체를 구속할 권한이 있음을 보증합니다.
• If using on behalf of a business, you represent that you have authority to bind that entity.

3. API Keys and Third-Party AI Services

3-1. 이용자 책임

3-1. Your Responsibility

• API 키는 이용자가 외부 서비스에서 직접 발급받아 사용합니다.
• You are solely responsible for obtaining API keys directly from third-party providers.
• API 키 사용으로 발생하는 외부 서비스 이용 요금은 전적으로 이용자의 책임입니다.
• All charges incurred through third-party AI services via your API keys are your sole responsibility.
• API 키 유출로 인한 피해에 대해 회사에 귀책 사유가 없는 한 회사는 책임을 지지 않습니다.
• Twinflo is not liable for losses from unauthorized use of your API keys where Twinflo is not at fault.

다음 행위를 금지합니다:

You agree NOT to:

• 서비스의 정상적 운영을 방해하는 행위
• Interfere with or disrupt the Service or its infrastructure
• 타인의 계정 도용 또는 개인정보 무단 수집
• Access other users' accounts or collect personal information without authorization
• 저작권·특허권 등 지식재산권 침해
• Infringe intellectual property rights of any party
• 불법적이거나 타인에게 해를 끼치는 콘텐츠 생성
• Use the Service to generate illegal content or content that harms others
• 회사의 명시적 서면 동의 없는 서비스 재판매
• Resell or sublicense the Service without our express written consent
• 연결된 외부 AI 서비스의 이용 약관을 위반하는 목적으로의 사용
• Use the Service in ways that violate any connected third-party AI service's terms

제5조. 콘텐츠 및 데이터 소유권

5. Intellectual Property

• 이용자가 생성한 프로젝트, 대화 기록, 결과물의 저작권은 이용자에게 귀속됩니다.
• You retain ownership of all content, projects, and outputs you create.
• 외부 AI 서비스를 통해 생성된 콘텐츠의 소유권은 해당 서비스의 이용약관에 따릅니다.
• Ownership of AI-generated content is subject to the terms of the respective third-party AI service.
• 회사는 서비스 제공·개선·보안 목적으로만 이용자 데이터를 사용하며, 영업 목적으로 판매하지 않습니다.
• Twinflo uses your data only for service delivery, improvement, and security. We do not sell user data.

제6조. 유료 서비스 및 환불

6. Payments and Refunds

• 현재 Twinflo 앱은 무료로 제공됩니다.
• The Twinflo app is currently available free of charge.
• 외부 AI 서비스 이용 요금은 이용자가 직접 부담하며, 해당 서비스의 환불 정책을 따릅니다.
• API usage costs are billed directly by third-party providers and are subject to their refund policies.
• 향후 앱 내 유료 기능 도입 시 Apple App Store 및 Google Play의 환불 정책을 따릅니다.
• Any future in-app purchases will be subject to the refund policies of Apple App Store and Google Play.

7-1. 서비스 중단

7-1. Service Availability

서비스는 '있는 그대로(AS IS)' 제공됩니다. 천재지변, 전쟁, 해킹, 외부 서비스 장애 등 불가항력으로 인한 서비스 중단에 대해 책임을 지지 않습니다.

THE SERVICE IS PROVIDED 'AS IS'. WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS CAUSED BY FORCE MAJEURE, INCLUDING NATURAL DISASTERS, CYBERATTACKS, OR THIRD-PARTY OUTAGES.

7-2. AI-Generated Content

• 외부 AI 서비스가 생성한 콘텐츠의 정확성, 완전성, 적법성에 대해 회사는 보증하지 않습니다.
• Twinflo does not guarantee the accuracy, completeness, or legality of any AI-generated content.
• AI 생성 콘텐츠 사용으로 발생하는 결과에 대한 책임은 이용자에게 있습니다.
• You are solely responsible for reviewing and taking responsibility for AI-generated content before use.

7-3. 책임 한도

7-3. Limitation of Liability

회사의 고의 또는 중과실이 없는 한, 서비스 이용으로 발생한 간접적·우발적·결과적 손해에 대한 책임을 지지 않습니다. 책임 한도는 대한민국 약관의 규제에 관한 법률 및 관련 법령이 허용하는 범위 내에서 적용됩니다.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWINFLO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY APPLICABLE LAW. EU/UK STATUTORY CONSUMER RIGHTS ARE NOT AFFECTED.

제8조. 준거법 및 분쟁 해결

8. Governing Law

• 본 약관은 대한민국 법률에 따라 해석·집행됩니다.
• These Terms are governed by the laws of the Republic of Korea.
• 분쟁 발생 시 먼저 쌍방 합의를 통한 해결을 시도하며, 합의가 이루어지지 않으면 관할 법원에서 해결합니다.
• We encourage informal resolution first. Unresolved disputes shall be settled by the competent courts of the Republic of Korea.
• EU/UK 거주 이용자는 해당 국가의 소비자 보호법에 따른 현지 구제 수단을 이용할 수 있습니다.
• EU/UK users retain the right to seek remedies under applicable local consumer protection laws.

제9조. 약관 변경

9. Changes to These Terms

• 중요한 변경 사항은 시행 7일 전 앱 내 공지 또는 이메일로 안내합니다.
• Material changes will be communicated via in-app notice or email at least 7 days before taking effect.
• 변경된 약관에 동의하지 않는 경우 서비스 이용을 중단하고 탈퇴할 수 있습니다.
• If you do not agree to updated Terms, you must stop using the Service.
